Terms of Service

PieceRates is a neutral marketplace and software platform. We help GCs post work, help Crews and PEOs find and bid on that work, and surface compliance information so the parties can work together with confidence.

• We are not a party to the work. Contracts for construction work are between the GC, the Crew, and the PEO. PieceRates is not an employer, general contractor, subcontractor, or agent of any user.
• We never touch labor money. Payment for work flows from the GC to the PEO, and from the PEO to Crew workers as the employer-of-record. PieceRates does not hold, escrow, transmit, or take any percentage of wages or crew earnings. We are not a payroll provider or money transmitter.
• The PEO is the employer-of-record. Payroll, employment taxes, workers’ compensation, and W-2/1099 classification are handled by the PEO under its own agreements and applicable state law.

PieceRates earns revenue exclusively from platform services, never from the work itself:

• Posting is free. GCs post jobs free and without limit.
• Bid credits (“Nails”). Crews and PEOs use prepaid Nails to submit bids. Nails can be purchased or earned free (profile completion, referrals, reviews, invitations, milestones). Nails have no cash value and are not redeemable.
• Visibility products. Optional featured listings, job promotion, boosts, and advertising placements, always labeled on the platform (e.g. “Featured”, “Sponsored”).
• PEO finder fees. When a PEO wins an engagement through PieceRates, the PEO pays a finder fee: a percentage of the GC project value, disclosed up front and invoiced only after the engagement is established (approximately 60 days into the project). This fee is charged to the PEO, never deducted from wages.
• No cut of the work, ever. PieceRates does not take a commission, percentage, or fee from amounts paid for construction work performed by crews.

• You must be at least 18, able to form a binding contract, and using the platform for business purposes.
• You are responsible for the accuracy of your company profile, licenses, insurance, and other information you post, and for keeping your credentials secure.
• One person may operate under multiple company contexts (e.g. a GC that also works as a Crew); each context is subject to these terms.

PieceRates surfaces and tracks compliance signals (verification status, certificates of insurance, workers’ compensation, licenses, and W-2/1099 gating) as provided by users and PEOs. We do not independently guarantee any party’s legal compliance, licensure, or insurance coverage. Classification rules are state-specific; the employer-of-record PEO is responsible for lawful classification and payroll.

• No fee circumvention: don't use the platform to find a counterparty and then move off-platform specifically to avoid platform fees you would otherwise owe.
• No false, misleading, or fraudulent listings, bids, reviews, or compliance documents.
• No scraping, reverse engineering, or interference with the platform's operation or security.
• Reviews must reflect genuine experience; we may remove content that violates these terms.

You retain ownership of content you post (profiles, photos, job descriptions, reviews) and grant PieceRates a non-exclusive, worldwide license to host, display, and distribute it to operate and promote the marketplace. You must have the rights to anything you upload.

The platform is provided “as is” and “as available.” To the maximum extent permitted by law, PieceRates disclaims all warranties and is not liable for the quality, safety, legality, or outcome of any work, engagement, or payment between users, nor for indirect, incidental, or consequential damages. Our aggregate liability is limited to the platform fees you paid to PieceRates in the twelve months preceding the claim.

You may close your account at any time. We may suspend or terminate accounts that violate these terms, create risk for other users, or abuse the compliance or bidding systems. Unused purchased Nails may be refunded at our discretion where required by law.

We may update these terms; material changes will be announced on the platform with a new “Last updated” date. Continued use after changes take effect constitutes acceptance. Questions: support@piecerates.com.
